Protection Orders

There are many types of civil orders available to protect people from domestic violence, harassment/stalking, and sexual assault.  There is also an order specifically designed to protect vulnerable adults from abuse, neglect, and financial exploitation.  If none these orders is available in your situation but you are filing for divorce, legal separation, custody, or parentage determination, you may be able to obtain a restraining order as part of the domestic relations case.

How do I get an order for protection?

The forms are free at the Chelan County Clerk's Office.  Pattern forms are also available on the Washington State Court Forms page in the Protection Orders category. Information regarding protection from abuse may also be found at WashingtonLawHelp.org.

After you complete the appropriate forms, a Judge or Commissioner will review your paperwork as soon as possible.  The judicial officer may ask you some questions and will decide whether to grant or deny an immediate temporary order, or set a hearing to determine whether or not an order should be granted.

A hearing will be held in approximately two weeks to grant or deny an Order for Protection effective for a longer period of time. During these two weeks, the respondent is served with both the Petition and the Temporary Order (if one was granted) and with notice of the date set for the hearing. You must attend this hearing even if the respondent has not been served or the case will be dismissed—meaning any protection the court granted will no longer be in effect. Security officers are available at the courthouse if you believe the possibility of danger exists.

Once you have a court order, it is important to remember:

  1. Keep a certified copy of the order with you at all times.
  2. The order is enforceable throughout the State of Washington.
  3. If there is a violation of your court order, call 9-1-1 or the local police. Tell them you have a court order and it is being violated.

Whether or not you have a court order, if you are being harassed, threatened, or assaulted, call 9-1-1, or the local police!!
