Marijuana Moratorium - Resolution No. 2015-94

A resolution enacting a moratorium on the siting of licensed recreational marijuana retail sales, production, and processing, and on implementation of Senate Bill 5052 and House Bill 2136.

Whereas, the Washington State Liquor and Cannabis Board (WSLCB) has adopted implementing rules to license production, processing, and retail sales of recreational marijuana and marijuana products;

Whereas, Chelan County previously declined to adopt regulations adding to state statutes and regulations governing recreational marijuana production, processing, and retail sales resulting from passage of Initiative 502;

Whereas, the legislature recently enacted HB 2136 and SB 5052 which remove or lessen some of the regulations contained in 1-502;

Whereas, the WSLCB, by letter dated September 23, 2015, informed local governments that it will begin accepting new applications for retail licenses on October 12, 2015, and will not limit the number of licensed retail stores;

Whereas, the WSLCB encouraged local governments to revise regulations before it begins processing new applications;

Whereas, there is not sufficient time between the date of the WSLCB notice and the date new applications will be accepted by them for Chelan County to conduct code drafting and required public notice and hearings;

Whereas, licensed recreational marijuana retail stores, production, and processing can have significant impacts on the community;

Whereas, much research and analysis is necessary before Chelan County can determine the impact ofSB 5052 and HB 2136 in this county, and the level and types ofregulations which may be necessary to address impacts;

Whereas, the board determines that it is necessary to enact a moratorium on the siting of licensed recreational marijuana retail sales, production, and processing, and implementation of SB 5052 and HB 2136;

Whereas, the board will conduct a public hearing on Tuesday, November 10, 2015 at 10:30a.m. regarding the moratorium;

Whereas, this moratorium will be for a period not to exceed six months unless extended for good cause by resolution at a later date, although it is hoped that it can be ended prior to six months;

NOW, THEREFORE, BE IT RESOLVED as follows by the Chelan County Board of Commissioners:

  1. 1. The above recitals are hereby adopted as findings of fact.
  2. Chelan County does hereby adopt a six month moratorium on the siting of licensed recreational marijuana retail stores, production, and processing, and on the implementation of SB 5052 and HB 2136, which shall expire unless renewed or otherwise extended as provided  in  RCW 36.70.795 and 36.70A.390.
  3. While this moratorium is in effect, no application for a building permit, occupancy permit, tenant improvement permit, fence permit, variance, conditional use permit, or other development permit or approval shall be accepted as either consistent or complete by any county department.
