Protection Orders Information

Step 1: Identify what kind of protection order you need.

Note

Whether or not you have a court order, if you are being harassed, threatened, or assaulted, call 911, or the local police!!

 

Civil Protection Order

Civil Protection Order is a civil order that restrains the person who has been committing acts of violence from further acts of assault or threat.

There are many types of civil orders available to protect people from domestic violenceharassment/stalking, and sexual assault.  There is also an order specifically designed to protect vulnerable adults from abuse, neglect, and financial exploitation.  If none these orders is available in your situation but you are filing for divorce, legal separation, custody, or parentage determination, you may be able to obtain a restraining order as part of the domestic relations case.

Extreme Risk Protection Order

A petition may be filed by a law enforcement agency, a law enforcement officer, or a person who is an intimate partner or family or household member of the respondent. Family or household members include:

  • Persons related by blood, marriage, domestic partnership, or adoption
  • Persons who currently or formerly resided together
  • Persons who have a biological or legal parent-child relationship, including stepparents and stepchildren, and grandparents and grandchildren, or a parent's intimate partner and children
  • A person who is acting or has acted as a legal guardian.

Step 2: Fill out your forms

The forms are free.  Pattern forms are also available on the Washington State Court Forms page in the Protection Orders category. Information regarding protection from abuse may also be found at WashingtonLawHelp.org.

 

Step 3: After completion, print out your forms and bring them to the Chelan County Clerk’s Office.

After you complete the appropriate forms, a Judge or Commissioner will review your paperwork as soon as possible.  The judicial officer may ask you some questions and will decide whether to grant or deny an immediate temporary order, or set a hearing to determine whether or not an order should be granted.

A hearing will be held in approximately two weeks to grant or deny an Order for Protection effective for a longer period of time. During these two weeks, the respondent is served with both the Petition and the Temporary Order (if one was granted) and with notice of the date set for the hearing. You must attend this hearing even if the respondent has not been served or the case will be dismissed—meaning any protection the court granted will no longer be in effect. Security officers are available at the courthouse if you believe the possibility of danger exists.

Once you have a court order, it is important to remember:

  1. Keep a certified copy of the order with you at all times.
  2. The order is enforceable throughout the State of Washington.
  3. If there is a violation of your court order, call 911 or the local police. Tell them you have a court order and it is being violated.

 

As required by Civil Protection Orders, chapter 215, Laws of 2021, the Administrative Office of the Courts has added translations for some protection order forms, instructions, and brochures on the Washington Court Forms homepage (https://www.courts.wa.gov/forms/?fa=forms.home&dis=y). We would like to thank the Pattern Forms Committee, Protection Order Forms Subcommittee, and Interpreter Commission for their guidance on this project. You may not be able to locate all the updated forms at the link provided above. However, we are working to improve those options over time.
